Terms of Service

These Terms of Service ("Terms") govern your use of the DoseToData mobile application ("the App"), operated by Twin Trails Ventures LLC ("Twin Trails Ventures," "we," "our," or "us"), a California limited liability company. By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. Not Medical Advice

DoseToData is a personal tracking tool, not a medical device or a source of medical advice. The App does not diagnose, treat, cure, or prevent any disease or condition. Any trends, insights, summaries, or reminders it provides are informational only and are generated from data you enter yourself.

Always seek the advice of a qualified physician or other healthcare provider with any questions about a medical condition or medication. Never disregard professional medical advice, or delay seeking it, because of something you read in the App. Do not start, stop, or change any medication based on the App. Do not rely on the App's reminders as your only means of managing medication. If you think you may have a medical emergency, call your doctor or your local emergency number immediately.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

3. Your Account and Your Data

You are responsible for the accuracy of the information you enter and for maintaining the security of the device and Apple ID used to access the App. Your health data is stored on your device and, for subscribers, synced through your own iCloud account. You retain ownership of the data you enter. Our handling of your information is described in our Privacy Policy.

4. Subscriptions and Payment

• Certain features require a paid subscription, purchased through the Apple App Store.
• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel your subscription in your App Store account settings.
• Refunds are handled by Apple in accordance with App Store policy; we do not process payments directly.

5. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the App
• Use the App for any unlawful purpose or in violation of any applicable regulation
• Interfere with, disrupt, or attempt to gain unauthorized access to the App or related systems
• Resell, sublicense, or commercially exploit the App without our written permission

6. Intellectual Property

The App, including its software, design, text, graphics, and the DoseToData name, is owned by Twin Trails Ventures LLC and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for your own personal, non-commercial use, subject to these Terms.

7. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that any data will be preserved without loss.

8. Limitation of Liability

To the maximum extent permitted by law, Twin Trails Ventures LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of the App. To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the App shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) US$50.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain liabilities, so some of the above may not apply to you.

9. Termination

You may stop using the App at any time by deleting it from your device. We may suspend or terminate your access to the App if you materially breach these Terms. Sections relating to intellectual property, disclaimers, limitation of liability, and governing law survive termination.

10. Changes to These Terms

We may update these Terms from time to time. We will indicate changes by updating the "Last updated" date above. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be brought in the state or federal courts located in San Diego County, California, and you consent to their jurisdiction.
